Talking on the phone while driving is now legal in India

Nitin Gadkari, the Union Road Transport and Highways said while answering one of the questions in Lok Sabha that there will be no challan for the use of Hands-Free Device while driving.

Therefore, talking on the mobile phone while driving the car is now not punishable now. If the traffic cops stops you and asks you for challan, then you can challenge it in the court.

However, the most important thing is that the mobile has to be in the pocket and not on the ear. It has to be connected with a handsfree device.

If you use the mobile phone to talk, then the traffic police will have the right to fine you.
